Terms of Service

Please read these terms carefully before using PromptifyApp.

Welcome to PromptifyApp, a brand of aysobeka. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and aysobeka (dba PromptifyApp) ("we," "us," or "our") governing your use of the PromptifyApp browser extension, website, and related services (collectively, the "Service").

1. Eligibility and Account Registration

  • Age Requirement: You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, e.g., 16 in certain EU countries) to use the Service. By using the Service, you represent and warrant that you meet this requirement.
  • Account Security: You may be required to register for an account to access certain features. You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
  • API Management: All backend AI processing is handled securely by the PromptifyApp team. You are not required to provide your own third-party AI API keys.

2. Description of Service and AI Disclaimers

PromptifyApp provides an AI-powered browser extension designed to enhance, structure, and optimize text prompts for various third-party AI platforms (e.g., ChatGPT, Claude, Gemini).
  • Third-Party Dependencies: Our Service relies on third-party Large Language Models (LLMs) and APIs. We are not responsible for the uptime, content policies, or changes in functionality of these third-party services.
  • Nature of AI Outputs: You acknowledge that artificial intelligence is continually evolving. The enhanced prompts and content generated by the Service ("Outputs") may not always be accurate, complete, or suitable for your specific needs. You are solely responsible for reviewing and verifying the Output before utilizing it.
  • Non-Uniqueness: Due to the nature of machine learning, Outputs may not be unique across different users. The Service may generate the same or similar Outputs for PromptifyApp users who input similar queries.

3. Subscriptions, Billing, and Payments

  • Tiers: We offer a Free Tier with limited daily enhancements, and Pro and Elite tiers with expanded capabilities. Features and limits are detailed on our pricing page and are subject to change.
  • Fees and Renewal: The Pro tier ($6.49/month) and Elite tier ($12.49/month) require a paid subscription. By providing payment information, you authorize our Merchant of Record (Paddle) to charge your designated payment method on a recurring basis (monthly or annually, as selected).
  • Taxes: Subscription fees are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes applicable to your purchase.
  • Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain Pro or Elite tier access until the end of your current billing cycle.
  • Refund Policy: We offer a 14-day money-back guarantee on all paid subscriptions. If you are not satisfied within 14 days of your initial purchase, contact us via our contact form for a full refund. After the 14-day period, subscription fees are non-refundable.   • EU/UK Consumer Rights: Our 14-day guarantee is in addition to any statutory rights you may have under the laws of the European Union or the United Kingdom.
  • Fair Use: To ensure high-quality service for all users, Pro or Elite tier accounts are subject to a fair use policy. We reserve the right to throttle or suspend accounts that exhibit abusive usage patterns or utilize automated bots/scraping tools.

4. Intellectual Property Rights

aysobeka (dba PromptifyApp) and its licensors retain all right, title, and interest in and to the Service, including its software, UI/UX, logos, proprietary algorithms, and documentation. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal or internal business purposes.
  • Your Inputs and Outputs: You retain all ownership rights to the original text prompts you submit ("Inputs"). Subject to your compliance with these Terms, PromptifyApp assigns to you all its rights, title, and interest in the Outputs generated from your Inputs.
  • License to Process: By submitting Inputs, you grant PromptifyApp a worldwide, royalty-free license to use, store, and process your Inputs and Outputs strictly for the purpose of operating, maintaining, and improving the Service.

5. Acceptable Use Policy

You agree not to use the Service to:
  • Violate any applicable local, state, national, or international law.
  • Generate, enhance, or distribute content that is defamatory, obscene, abusive, invasive of privacy, or promotes violence, hate speech, or discrimination.
  • Infringe upon the intellectual property rights or privacy rights of any third party.
  • Reverse-engineer, decompile, or disassemble any aspect of the Service.
  • Bypass or attempt to bypass any security measures, rate limits, or access controls.
  • Use the Service to develop a competing product or service.

6. Privacy and Data Security

Your privacy is important to us. Our collection, use, and storage of your personal data and prompts are governed by our Privacy Policy. By using the Service, you consent to the data practices described in the Privacy Policy. We implement industry-standard security measures to protect your data but cannot guarantee absolute security against unauthorized access or breaches.

7. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms or suspected fraudulent/illegal activity. Upon termination, your right to use the Service will immediately cease.

8. Disclaimers of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. AYSOBEKA (DBA PROMPTIFYAPP) EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AYSOBEKA (DBA PROMPTIFYAPP), ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL).
  • IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50.00) OR THE AMOUNT YOU PAID TO PROMPTIFYAPP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless aysobeka (dba PromptifyApp) and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service or violation of these Terms.

11. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be resolved by binding arbitration administered by the International Chamber of Commerce (ICC) in accordance with its rules.
  • Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class action or representative proceeding.

12. Force Majeure

PromptifyApp shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, internet service provider failures, or third-party AI API outages.

13. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. Material revisions will include at least 30 days' notice.

14. Miscellaneous

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary.
